Misdemeanor Possession

Possession of marijuana is a misdemeanor if the person is carrying less than an ounce. Even a single joint can result in a misdemeanor charge. If you are found guilty of misdemeanor possession, you could face up to a year in prison and up to a $1,000 fine.

Felony Possession

In Georgia, illegal possession of any drug other than one ounce of marijuana is charged as a felony. Both illegal and legal drugs can be subject to possession charges, including prescriptions such as:

  • Xanax
  • Adderall
  • Ambien
  • Valium
  • Ketamine
  • Oxycontin

If you possess these drugs without a prescription, or even if you have a prescription but the pill is not in the original container, you could be charged with possession.

Possession of more than an ounce of marijuana is also a felony, which can bring up to 10 years in prison and up to a $5,000 fine.
