Woman faces drug charges after distracted driving traffic stop

Drug charges can come about in many ways in Georgia and the circumstances are imperative to planning an effective legal defense. For example, while some arrests for drug infractions are connected to a long-term investigation, drug trafficking, drug distribution and other serious charges, people could get caught because of a different violation and law enforcement might end up alleging that drugs were found.

For example, according to recent reports a woman whose vehicle was stopped because she was using a cellphone was arrested on drug charges. The incident happened in the evening as the 39-year-old woman was subjected to a police investigation for a cellphone violation. After the stop, drugs were allegedly found in the vehicle, including ecstasy pills and marijuana in separate bags. Law enforcement officials also allegedly discovered scales and a gun. The suspect is facing multiple charges for possession of drugs, having tools used to commit crimes and possessing a firearm while committing a crime. These are felonies. She also has misdemeanor charges against her for drug paraphernalia and the cellphone violation.

There is no doubt that drug charges must be taken seriously by law enforcement. But, when the arrest comes about as part of a separate investigation based on a different violation, it is important to consider the possibility that the evidence accrued might be tainted. There could have been other mistakes made as law enforcement conducted its search. It is possible there could be a reduction of some of the charges through a plea negotiation.
